If you apply for FMLA and waste that time either using your drug of choice or you leave rehab, there is no guarantee that your job will be protected.

Therefore, they find that they are discriminated against for their addictions but their employer or their co-workers. The Americans with Disabilities Act, also known as the ADA, was designed to specifically prevent this type of discrimination at your current job or any other job that you may apply for in the future. The premise behind this law is that once you are either in recovery from drugs or alcohol or you have recovered, your disease cannot be held against you and used as a reason to fire you or deny you a job. 

There are several other federal protections that you have as well including the Rehabilitation Act of 1973, the Fair Housing Act as well as the Health Insurance Portability and Accountability Act (HIPAA). It’s also important to remember that if it makes you feel more comfortable, you don’t have to disclose to your employer that you’re working through a treatment program. Your treatment team can help you to develop a recovery plan that does not interfere with your current work schedule. Ultimately, the decision is up to you. On average, detox will last approximately seven days. The first three days of your time in detox will likely be the most challenging as this is when you will experience the height of your withdrawal symptoms. After your week in detox, you will be in a much better mentality to be able to truly focus on the steps that you need to take to work through the contributing factors of your addiction. 

Once you have made the decision that you want to commit to an outpatient program, the next step is to make a decision regarding the type of outpatient program you would like to work through. Similar to an outpatient program, an inpatient program can last anywhere between 30 and 90 days. Keep in mind that you can also adjust your treatment plan to account for both an inpatient and an outpatient plan. For example, you have the option to begin your recovery program in an inpatient program and then ultimately transition into a longer outpatient program. It’s important that you continue to communicate and interact with your treatment team so that you can make any adjustments that may be needed during the course of your recovery.
